More Canadian Employers hiring foreign workers | Canada Immigration: Canadian employers hire foreign workers through 100 different work permits. With the only exception of 2020, these numbers have been increasing since 2015 & there are no signs of stopping. Canada is facing a high number of job vacancies & a low unemployment rate, which means that there are more job availability but less qualified workers to fill the jobs. The increase of vacancies happened alongside the fall of Canada’s unemployment rate, which was around 5.4% in December 2021, the lowest since 5.2% which was in December 2019.

Many sectors within Canada have high numbers of job vacancies and not enough workers in Canada to fill them. Recruiting foreign workers is one way Canadian Employers can fill vacant positions in their company. Foreign workers need a work permit to work legally in Canada. In certain cases, the Employer has to do LMIA which is known as Labour Market Impact Assessment, although most of them are issued are LMIA-exempt.

LMIA & LMIA Exempt work permits

There are two major work permit programs for work permits –
  • TFWP(Temporary Foreign Worker Program)
  • IMP(International Mobility Program)

The only difference between the two is that the TFWP requires employers to get an LMIA, whereas IMP work permits are LMIA-exempt.

The whole process of how TFWP works is basically to address labour shortages in Canada. Employers must complete the LMIA process to demonstrate to ESDC (Employment & Social Development Canada) for the hiring of a foreign worker is due to a “shortage of workers“. The ESDC then accesses the LMIA to confirm that hiring a foreign worker will have no negative impact on the Canadian Labour Market. Once the Employer receives a positive or neutral LMIA, they provide a copy to the foreign worker so they can submit it with their work permit application to IRCC( Immigration, Refugees and Citizenship Canada). The employee can then work once their work permit is approved.

The IMP exists to uplift Canada’s social and economic objectives, so there is no need for a labor market test. There are many IMP work permits resulting from Canada’s free trade- agreements. For example, CUSMA (Canada-United States- Mexico Agreement) is a free trade agreement between the US and Mexican Citizens who are able to work in Canada under the IMP. Canada also allows international student graduates & eligible common-law partners to open work permits under the IMP. All open work permits fall under the IMP.

The first step is to complete the LMIA requirements for the work permit that you wish to apply for. Once you get the LMIA done, you can then give a copy to foreign employees to apply to IRCC. They will need to submit a contract & a job offer letter,  which includes information about their pay scale, their responsibilities, and conditions for example hours of work.

If they are approved, they will receive a letter of introduction. They can get their work permit from a border service officer when they arrive in Canada.
